Fees incurred in arbitration proceedings administered by the Shanghai International Arbitration (Hong Kong) Center (hereinafter “SHIAC HK”) include fees of institution, fees of arbitral tribunal, fees of emergency arbitrator, and other fees.

Fees of Institution

Fees of institution consist of a non-refundable registration fee of HKD6,000 per case and administrative fees calculated by the range of the amount in dispute (see Schedule 1), subject to a cap of HKD458,000.

Fees of Arbitral Tribunal

Fees of arbitral tribunal include the arbitrators' remuneration and other expenses. Where the parties fail to agree in writing to calculate the arbitrator's remuneration on the amount in dispute within 30 days from receipt of the Notice of Acceptance/Notice of Arbitration from SHIAC HK, the arbitrator's remuneration will be charged hourly.

Where the arbitrator's remuneration is calculated on the amount in dispute, the maximum amount payable to one arbitrator is determined by the range of the amount in dispute in the case (see Schedule 2), subject to a cap of HKD12,000,000.

Where the arbitrator's remuneration is calculated based on an hourly rate, the parties may negotiate with the arbitrator on the hourly rate. Unless agreed by the parties or determined by SHIAC HK in exceptional circumstances, the maximum hourly rate of an arbitrator is HKD6,500.

In addition to the arbitrator's remuneration, the parties shall pay in advance to SHIAC HK the arbitrator's reasonable expenses incurred in connection with the conduct of the arbitration, including, but not limited to, travel, food, and accommodation.

Fees of EmergencyArbitrator

Fees of emergency arbitrator include the costs of SHIAC HK for administering the Emergency Arbitrator's proceedings and the Emergency Arbitrator's remuneration. When applying for the appointment of an emergency arbitrator by SHIAC HK, the parties shall pay in advance the emergency arbitrator's fee of HKD100,000, subject to a cap of HKD150,000.

Other Fees

Other fees include additional reasonable expenses incurred by the parties in connection with the arbitration proceedings that are required to be paid by the parties under the arbitration rules applicable to the case, including, but not limited to, translation and transcription costs and the use of the hearing room incurred in connection with the conduct of the hearing at SHIAC HK.

In addition to the fees incurred in the administration of the arbitration proceedings as described above, SHIAC HK may also charge fees for acting as the appointing authority for ad hoc arbitrations as agreed by the parties or providing assistance of document management, hearing room renting, financial management, and tribunal secretary in these cases.
